Pleio Internal SMS Text Messaging Terms of Use

1. About These Terms
These Terms of Use (“Terms”) govern your participation in Pleio, Inc.’s (“Pleio,” “we,” “us”) SMS text messaging programs. By confirming your mobile phone number to Pleio and opting in to receive SMS messages, you agree to these Terms. If you do not agree, do not opt in, or reply STOP to any message to discontinue.
These Terms apply to the following SMS program:
- GoodStarter Internal Communications — an internal program for Pleio employees and contractors (“GoodStarters”) providing operational and business communications.
2. Definitions
- “PHI” means Protected Health Information as defined at 45 CFR § 160.103.
- “Participant” means a person who has opted in to receive SMS messages from Pleio under either program.
- “SMS” means short message service text messages, including MMS where applicable.
3. GoodStarter Internal Communications (Employee/Contractor Program)
3.1 Program Description
This program provides operational SMS communications to Pleio employees and contractors (“GoodStarters”) in support of their work for Pleio. Messages may include scheduling, coverage, training notifications, IT/security alerts, and other operational coordination.
3.2 How You Opt In
Participation is established through your employment or contractor relationship with Pleio and is governed by Pleio’s internal policies, including any Acceptable Use Policy and the Pleio GoodStarter Handbook.
3.3 Message Frequency
Message frequency varies based on operational needs.
3.4 PHI Prohibition
The GoodStarter Internal Communications channel is not an approved channel for the transmission of PHI. Participants must not send or include PHI in SMS messages through this channel. Communications involving PHI must be conducted through Pleio’s HIPAA-compliant systems. Violations are addressed under Pleio policy.
4. Message and Data Rates
Message and data rates may apply depending on your mobile carrier and plan. Pleio is not responsible for carrier charges incurred by Participants.
5. Carrier Liability
Carriers are not liable for delayed or undelivered messages. Delivery is subject to carrier availability and network conditions and is not guaranteed.
6. Opting Out and Help
6.1 Opt-Out
You may withdraw your consent to receive SMS messages at any time. You can opt out by replying with any of the following keywords to any message: STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, UNSUBSCRIBE. You may also opt out by any other reasonable means that clearly communicates your wish to stop, including by contacting Pleio at the information below.
Opt-out requests are honored immediately upon receipt. Pleio will send a single confirmation message acknowledging your opt-out, and will complete any related administrative processing within ten (10) business days. You will not receive further SMS messages after opting out, other than that confirmation.

7. Privacy
Pleio’s collection and use of information through these SMS programs is described in our Privacy Policy (available at https://stg-pleacom-staging.kinsta.cloud/privacy-policy/), which is incorporated by reference. In connection with SMS, Pleio collects message content and metadata (including timestamps and delivery status), and your opt-in/opt-out records.
Pleio does not sell or share SMS data as those terms are defined under the California Consumer Privacy Act and other applicable US state privacy laws. SMS information is processed by Pleio’s service providers (including Twilio and Microsoft) under contract on Pleio’s behalf and is not used by them for their own purposes.
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors supporting these services is permitted. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

9. Acceptable Use
SMS messaging must be used consistent with applicable law and Pleio’s policies. Prohibited use includes unlawful, abusive, harassing, or fraudulent content; impersonation; and use of the GoodStarter Internal channel for PHI.
10. Service Availability; Suspension
Pleio may suspend, modify, or terminate the SMS program at any time, with or without notice, for compliance, operational, or security reasons.
11. No Warranty; Limitation of Liability
SMS services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Pleio disclaims all warranties, express or implied, and shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to your participation in the SMS program.
12. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in New York.
13. Changes to These Terms
Pleio may update these Terms from time to time. Material changes will be posted at this URL with an updated Effective Date and, where appropriate, communicated to active Participants. Continued participation following the Effective Date of any update constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
